Terms of Service
Effective Date: September 2026. Official terms governing digital engineering milestones, commercial code transfer, service level guarantees, and agency client relationships.
01. Engagement Scope & Project Roadmaps
Every commercial engagement with Instant Growth (SMC-Private) Limited is defined by a formalized Statement of Work (SOW) or Milestone Deliverable Schedule agreed upon before code initiation. Our services encompass custom web and mobile application engineering, SaaS API architecture, performance digital marketing, technical search engine optimization (SEO), brand identity design, 4K video production, and YouTube/TikTok creator channel automation.
02. Full Intellectual Property (IP) Transfer
We believe in absolute transparency and client empowerment regarding software ownership:
- Unconditional Code Transfer: Upon 100% financial settlement of contractual invoices, all custom source code, databases, design tokens, Figma prototypes, and multimedia assets are fully transferred to the client.
- Zero Hidden Royalties: Instant Growth does not retain recurring licensing claims, proprietary lock-ins, or ongoing royalties over custom-built client applications.
- Open-Source Frameworks: Third-party open-source components (e.g., React, Three.js, Node.js) remain governed by their respective permissive licenses (MIT, Apache 2.0).
03. Performance Standards & QA Warranty
All software deliverables are engineered according to world-class technical benchmarks:
- Sub-Second Performance SLA: Web builds are audited for Core Web Vitals (90+ Google PageSpeed score targets and sub-1.5s visual loads).
- 30-Day Post-Launch QA Warranty: Any technical bugs, UI rendering inconsistencies, or deployment defects discovered within 30 days of launch are resolved promptly at zero additional cost.
04. Payment Milestones & Billing
Project payments are structured around clear sprint verification milestones:
- Fixed-Scope Projects: Standard structure entails an initial kickoff deposit (e.g., 40%), beta demonstration milestone (30%), and final production handover (30%).
- Monthly Growth Retainers: Creator automation, SEO management, and dedicated engineering retainers are billed monthly in advance.
- Accepted Payment Rails: Direct Corporate Bank Wire, Payoneer, Stripe, and Raast / local commercial transfers. Official NTN tax invoices are provided for all transactions.
05. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the corporate statutes and mercantile laws of Pakistan under SECP regulatory jurisdiction (Company Inc. No: 0346894, NTN: J498553). Any dispute arising under these terms shall be resolved through good-faith executive consultation or formal arbitration in Peshawar, Pakistan.
